Terms and Conditions for Online Events, Public Classroom Courses, Webinars, WebCasts, and eLearning modules

CSK Management GmbH (“CSK”)

1 Preamble

CSK Management GmbH provides public events and courses (class-room training, webinars, webcasts, and eLearning) exclusively based on these terms and conditions. Additional or contradictory terms are excluded. Changes, additions and supplements require explicit written confirmation by CSK. These terms and conditions do not apply to other service, i.e. in-house courses, coaching and consulting.

2 Registrations

The number of participants may be limited due to didactical, technical or organizational reasons. Participants are regarded in order of their registrations. Participant data are kept electronically for administration purposes. The requests are processed by CSK using electronic data processing. The customer agrees to the handling of his data, as it has become disclosed to CSK via contract, to the extent necessary for the business relationship. Personal data may be used according to data protection regulations by CSK and its partners. Additional use of personal and customer data requires explicit permission by the customer.

3 Course Fees

The fees published at the time of ordering are authoritative for invoicing. Fees are listed excluding potential local VAT. Published fees are subject to change at any time without further notification. The fees for attending one of CSK’s courses have to be paid in the invoice currency; they are due at the first day of the course unless stated otherwise. Partial attendance of courses does not permit participants to reduce the course fee. If the payment period is exceeded, CSK may apply interest charges to the customer’s account without further notifications; according to legal regulations.

In case of online registrations, customers receive a PDF invoice/receipt with 48 hours after booking. On request, we also send paper copies by mail.

4 Cancellation and Retraction

The registration is binding. In case of circumvention, customers may change or cancel their registration up to 10 days before the course start. Following conditions apply to changes or cancellations after this period

CSK reserves the right to cancel a course due to organizational or technical reasons. In case of a cancellation by CSK, participants are entitled to a rescheduling of the course date or full refund of the course fee; further claims do not persist. In case of a group reservation of 5 or more participants, dates and number of participants are binding from the booking date.  CSK will decide about the course execution not later than 10 days before course start. CSK reserves the right to cancel a course due to organizational or technical reasons. In case of a cancellation by CSK, participants are entitled to a rescheduling of the course date or full refund of the course fee; further claims do not persist. In case of a group reservation of 5 or more participants, dates and number of participants are binding from the booking date. In case of credit card refunds, CSK may charge EUR 25 / USD 30 to cover credit card and booking fees.

5 Change of Course Execution

CSK has the right to change course dates, locations and trainers.

6 Course Benefits

Duration, price, objectives, content, target audience, preconditions and details about the execution of a course are listed in the course description. For class-room courses, the fee includes materials, handouts and information system usage (if applicable). Travel costs, meals and accommodation are not included in the course fees.

7 Certification

Participants can request a certification of attendance upon successful completion of a course. According to the course type, the participant is registered at the certifying organization - i.e. APMP/APMG. The attendance of the full course is required for additional certification.

8 Licensing and Copyrights

CSK’s services include the execution of the course, and the provision of course materials for later use of the participant. CSK grants limited rights to the participant. The participant is entitled to use any course material for own and internal purposes only. Additional permissions are reserved by, especially translation, reprint and redistribution of course materials or parts of them. No part of the training material may be reproduced, processed using electronic systems, printed or used for public presentation - even for the creation of own courses - without written permission by CSK. The recording of public courses using electronic systems (audio / video) is not permitted without permission by CSK.

9 Warranty

CSK provides limited warranty for damages caused by gross negligence or deliberate intention. In case of gross negligence, the liability is limited to typical average claims according to the type of service, as typical to the contract, and predictable damages. This extends to legal representatives and service providers of CSK. Civil warranty is excluded, to the legal extent of Swiss law. In case of a course cancellation due to force majeure, the liability for vainly arrived course participants is limited to max. CHF 100.00 per person.

10 Miscellaneous

CSK is permitted to use the services of third parties for the execution of their courses, regardless of type and content of the particular course. Swiss law applies to the contract relationship and its execution. If one or more terms of these Terms and Conditions should be ineffectual, the contract parties will replace the ineffectual or incomplete regulation appropriately, in the spirit of the desired regulation. The validity of other regulations remains untouched. CSK reserves the right to change their curriculum and their Terms and Conditions any time. The effective conditions upon conclusion of the contract remain valid, which participants will receive with their course confirmation. Court of jurisdiction is Zürich.
